Release of Liability & Waiver Agreement

Please read the agreement below, then complete the information at the bottom of the page to submit your signed waiver. All participants must sign this waiver in order to participate in any and all activities offered at The Wonder Lab.

In consideration of being permitted by Wonder Lab LLC, d/b/a The Wonder Lab, to participate and frequent its business, the undersigned, on his or her behalf, and on the behalf of the Participant(s) identified below, acknowledges, appreciates, understands, and agrees to the following:

1. I represent that I am the parent or legal guardian of the Participant(s) named below or I have obtained permission from the parent/legal guardian of the Participant(s) named below to execute this agreement on their behalf.

2. I acknowledge and understand that there are known and unknown risks associated with participation in The Wonder Lab’s activities and the use of the facility, which include but are not limited to: contusions, fractures, scrapes, cuts, bumps, paralysis, or death. Such dangers and risks include but are not limited to:     

   1. Falling on or from the equipment

   2. Tripping

   3. Choking

   4. Collisions with the equipment or with other participant.

3. I, for myself and the Participant(s) named, willingly assume the risks associated with participation and accept that there are also risks that may arise due to OTHER PARTICIPANTS which I also willingly assume.

4. I agree that the Participant(s) named, and I shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions as conditions for participation in any party, event and/or any other open play at The Wonder Lab. I acknowledge that failure to do so may result in expulsion from The Wonder Lab’s premises.

5. I, for myself, the Participant(s) named, our heirs, successors, assigns, representatives, and next of kin agree to hold harmless, release, waive and indemnify The Wonder Lab, its owners, members, officers, employees, equipment manufacturers and sponsoring agencies from all liability for any such personal injury, disability, death or loss or damage to person or property to the fullest extent of the law.

6. I additionally agree to indemnify the owners of The Wonder Lab’s facility, Wonder Lab LLC, their predecessors, parent, subsidiaries and affiliates, officers, successors, assigns and employees for any defense cost or expense arising from any and all claims, injuries, liabilities or damages arising from participation, except for those arising from the gross negligence or willful misconduct of The Wonder Lab.

7. I, for myself, my child(ren) or ward(s) understand that my execution of this waiver on the initial visit will authorize The Wonder Lab to enter this waiver into its database and use it as a continuous, multi-use waiver for my child(ren)’s ongoing participation in the activities or use it as a waiver executed for my other child(ren). I hereby expressly authorize The Wonder Lab to use this Waiver as a multi-use waiver until I revoke it in writing.

8. I am of physical ability to participate and am legally competent to understand and complete this agreement. I hereby execute this agreement without coercion.

9. I understand that entry, by myself and the participant(s) named, constitutes consent for The Wonder Lab to use any film, video, or likeness of participants for any purpose whatsoever, without payment to the participant.

Parent or Guardian Certification and Consent

I hereby certify that I am the parent or guardian of the participant whose name(s) appears below, and I have authority to waive rights on behalf of the minor participant. I have read and understand all the provisions of this document and the risks of the activities. I understand that the activities could cause injury and even death. I acknowledge that I have read and understand the terms of this document and I am freely and voluntarily signing this document.

The Wonder Lab Rules and Regulations

• A waiver signed by the minor’s parent or legal guardian, is required for each participant before entering the play space.

• No drops-off allowed for open play sessions, birthday parties, or parent-child classes.

• No shoes are allowed inside the play area. Socks or shoe covers are required for EVERYONE inside the play area.

• No sharp objects allowed in the play space.

• No roughhousing.

• Respect others around you.

• One Warning: If anyone from The Wonder Lab’s staff sees children playing in a way that is dangerous, we will ask them to stop and do our best to locate the parent/guardian to ask them to help us control the child’s behavior. After one attempt to control the behavior of the child that might cause harm to him/herself or to other children, we may ask you to leave for the day and your entrance fee is non-refundable.

• Sick Child Policy: Please refrain from bringing in a child with any type of contagious illness. This is a children’s indoor playground and we aim to keep our environment as healthy as possible.

• We are not responsible if your child leaves the premises.

• We require that all parents monitor their own kid(s) at ALL times. The Wonder Lab is NOT responsible for any child insult or injury complaints and claims by others.

• Adults are responsible for monitoring their beverages responsibly. This includes but is not limited to hot drinks such as tea and coffee.

I, THE UNDERSIGNED, HAVE READ THIS AGREEMENT FULLY, AND UNDERSTAND ALL OF ITS TERMS INCLUDING THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING IT. I HEREBY SIGN FREELY, VOLUNTARILY, AND WITHOUT INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME, AND I INTENDED MY SIGNATURE TO BE A COMPLETE AND CONTINUING RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
